According to the Charlotte Observer home burials are legal. The question seems to have come up after a woman went viral for burying her mother in her backyard. So if you decided this is the way you want to go, here are some rules.
State law requires that all burials or cemeteries must be at least 300 feet from a water supply. I think you can see how that makes sense. Also, state law requires the top of “burial vaults or other encasements,” must be at least 18 inches below the ground.
It also makes sense to check with your local zoning office. By the way, caskets are not required. I would suggest it though. Just saying.
I know that lots of people used to have family cemeteries on their property years ago. So I would assume these are rules that have not been looked at in many years.
So how about spreading ashes? It’s OK to scatter ashes on your own private property. If you want to scatter ashes on someone else’s property, you must get written permission from the landowner and give it to the crematory.
That means Disney is out of the question. They have a huge problem with people trying to do that at the parks. People have devised all kinds of ways o sneak their dearly departed into the Magic Kingdom so they can become part of one of the rides. Not allowed, and not a good idea.
So North Carolina is OK as long as it’s your property and you follow a few simple rules.
