New Mexico Rules That Gas Stations Can Be Held Liable For Doing This
I just don’t see how they think this makes sense.
A bar can get in a lot of trouble for serving alcohol to an intoxicated customer – and now New Mexico is extending the same logic to gas stations and drunk drivers.
A New Mexico court ruled this week that gas stations have a “duty of care” not to sell fuel to drivers who are clearly intoxicated. The ruling declared that “Providing gasoline to an intoxicated driver is like providing car keys to an intoxicated driver”. Do you agree with this ruling? How can this really be enforced. What if the person was just adding to the tank. Then the gas station didn’t sell them the gas they used while driving intoxicated? Just stupid
